Kurpark Suites Bad Aibling

Our Terms and Conditions, Contract and Cancellation Policy in accordance with the DTV Deutscher Tourismusverband:

Guest Accommodation Contract

As soon as the guest books, they enter into a guest accommodation contract with the host (holiday apartment/private room/hotel). It does not matter whether the contract was concluded online, verbally, or in writing. The guest also makes the booking on behalf of all other accompanying persons, provided this has been expressly agreed.

Agreed Services

Which services have been agreed between the accommodation provider and the guest is determined by the information in the booking offer, the brochure or website information, and the booking confirmation.

Compliance with the Contract

Both the accommodation provider and the guest are obligated to comply with the contract. The principle "booked is booked" applies. The host must make the booked accommodation available to the guest, and the guest is obligated to pay the agreed accommodation price.

Cancellation/Withdrawal

Free cancellation by the guest is therefore excluded. If the guest fails to arrive at all, or withdraws from the contract during the stay, they are obligated, regardless of the reason or timing of the cancellation, to pay the agreed price less any expenses saved. Saved expenses include, for example, laundry, breakfast, electricity, and heating. The host, in turn, becomes liable for damages if they are unable to provide the guest with the booked accommodation - for example, due to overbooking - and also cannot provide adequate alternative accommodation. According to current case law, the following flat-rate percentages are to be deducted as saved expenses: 20% for overnight stay with breakfast, 30% for half board, 40% for full board.

For holiday apartments and holiday homes, a flat rate of 10-20% is deducted. However, the host is obligated to keep their loss as low as possible and, if possible, to re-let the room/apartment. The host must offset any savings against the cancellation fee.

If the guest can prove to the host that the host incurred no loss (through re-letting) or a significantly lower loss, the guest need not pay any, or significantly lower, cancellation costs.

Provision of Services

The contractually agreed services are also binding for the host. They must provide the services as offered and agreed in the listing. This includes, first and foremost, the provision of the promised accommodation. If the host has mistakenly double-booked a room or apartment, they must promptly arrange equivalent or better alternative accommodation, as the guest is entitled to claim damages.

Prices

For accommodation businesses, it is internationally common to state prices per room, whereas in Germany prices are stated per person. For holiday apartments and holiday homes, the price is stated per unit and period of use (e.g. a daily rate or weekly rate for a specific occupancy and number of people).

Price Presentation

The German Federal Court of Justice (Bundesgerichtshof) has ruled that providers of holiday apartments or holiday homes must state the total price when quoting prices. The DTV also recommends this for the rental of private rooms. This means that the total price stated by the accommodation provider must include all flat fees and any ancillary costs that must be paid in any case, such as electricity, water, gas, heating, final cleaning, and use of bed linen. The host may bill consumption costs separately if the guest is offered consumption-based billing, e.g. for electricity, water, gas, or heating. In this case, a meter must be present and billed correctly.

Separate billing for bed linen and final cleaning is possible if the guest is clearly given the choice from the outset. This means the guest can choose whether to pay for the final cleaning or do it themselves.

Whether the local visitor's tax (Kurtaxe) must be included in the total price is a matter of debate. The DTV recommends calculating the visitor's tax separately from the rental price. In accordance with the DTV Deutscher Tourismusverband.

Surveillance System

The guest/tenant is aware of the type and extent of the surveillance cameras installed on the property, which are located in the access areas, stairwell, and courtyard area of the premises. This surveillance serves to improve general safety within the building. By making a booking, the guest/tenant fully accepts and agrees to this surveillance system.

Severability Clause

Should individual provisions of this guest accommodation or hospitality contract be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
